§ 6.22.140. Violation—Infraction.

  • Every person who, for himself or herself, or as the agent of another, commences, engages in, conducts or carries on any sale as provided in this chapter without procuring the permit required by Section 6.22.040, or who fails to comply with the conditions and provision of this chapter shall be punishable by:

    A.

    A fine not exceeding one hundred dollars for a first violation.

    B.

    A fine not exceeding two hundred dollars for a second violation within the same calendar year.

    C.

    A fine not exceeding five hundred dollars for the third violation within the same calendar year.

    D.

    A fine not exceeding one thousand dollars for each additional violation within the same calendar year.

    E.

    For the purpose of this chapter, a calendar year shall begin at 12:01 a.m. on January 1 of the current year and terminate at midnight on December 31 of that same year.

    F.

    In addition to the penalties established by the chapter, violations of any section of this chapter will result in the garage sale being ordered terminated by the chief of police or his designee.
