§ 13.48.010. Declaration of policy.

  • A.

    Adequate and proper solid waste management must be instituted and maintained by the city for the protection of the public health, safety and welfare.

    B.

    The City Council of the City of Delano finds that to give practical effect to this policy, a comprehensive system for the management of solid waste including periodic collection, removal and disposal of refuse/solid waste/recyclables from all places and premises within the city is essential and to accomplish this purpose for the best interest and welfare of all the inhabitants of the city and for the general benefit of the community at large, it is necessary to provide that such services should be paid for directly by the owner and/or occupant of all uses of property in the city, and therefore, all such owners and/or occupants are made liable for the charges set by the city council.

    C.

    Every such owner and/or occupant shall pay such charges whether or not they use refuse/solid waste/recycling services in all cases where such requirement is lawful.

    D.

    Proceeds from rates and charges for refuse service may be used for purposes of sweeping of public streets and alleys.

    E.

    The rates for recycling and green waste services provided by the city or its contractor may be set by a resolution of the city council.
